TERMS OF “SHARE YOUR STORY”
For good and valuable consideration herein acknowledged as received, including the potential to be featured in CureSearch materials, I have willingly and voluntarily provided the materials and information hereby submitted (“Submitted Materials”) and hereby grant to CureSearch for Children’s Cancer (“CureSearch”) and its trustees, officers, employees, agents, representatives, clients, successors, contractors, vendors, affiliates, assignees and/or anyone acting under the authority or permission of any of such entities or persons, an unrestricted, irrevocable, exclusive, royalty-free, world-wide, perpetual, sublicensable, assignable, license to use, reproduce, make derivatives, edit, modify, publish and/or broadcast the Submitted Materials, including my name, image, likeness, voice, biographical and/or occupational description, quoted statements, statement of type of cancer by which I am affected, photographs, and/or artwork, in any way, including in advertising and publicity, video or audio recording, still photograph, motion picture film, video production or reproduction, direct mail piece, greeting card, newsletter, web site article, press release, sound track recording, film strip, pin-up, in any media, including the Internet, now known or hereinafter created, without any additional financial compensation, including for any commercial use. I also consent to the use of any printed matter in conjunction therewith. I acknowledge that CureSearch, in its discretion, may choose not to use any of the Submitted Materials. I hereby release whatever rights, title or property interest I may have in the materials created from the Submitted Materials. I hereby waive any right that I may have to inspect or approve the finished product, or products and the advertising copy or other matter that may be used in connection therewith or the use to which it may be applied. I further understand that CureSearch is and shall be the exclusive owner of all right title and interest (including copyright) in and to the created materials and grant it the right to copyright or obtain appropriate intellectual property protection for any of the created materials.
I represent that all permissions, authorizations, acts, statements and/or items provided are done so in a lawful and truthful way which is not inconsistent with my legal and contractual obligations to third parties. I represent that any artwork or photographs supplied by me are original to me, that they do not infringe on any third party rights, that no third party is required to provide permission for their use. I hereby release, discharge and agree to hold harmless and to indemnify CureSearch, and the CureSearch legal representatives, trustees, officers, employees, agents, representatives, clients, successors, contractors, vendors, affiliates, assigns and/or anyone acting under the authority or permission of any of such foregoing named entities or persons, from any and all claims, losses, costs arising out of, or resulting from, my providing the Submitted Materials, or by virtue of any use, distortion, alteration or use in composite form, said materials, as well as any publication thereof, including without limitation any claims of copyright infringement, rights of publicity, defamation or invasion of privacy, other assertion of intellectual property rights, and including, but not limited to direct, indirect, incidental, special, consequential or punitive damages, even if CureSearch is aware of the possibility of such damages.
I certify I am over 18 years old. I understand that this is a binding contract, that I have read it and understand its terms and conditions and agree to be bound to them.
